Health Disclaimer

This document sets out the conditions of use of the Trexana app that relate to your health, the risks inherent in physical training and the limits of what the app does. It forms an integral part of the Terms of Use and is to be read together with them.

1. Status of this document and relationship to other documents

This document forms an integral part of the Terms of Use and applies to all use of the app, whether free of charge or under a paid subscription, from the conclusion of the contract described in section 4 of the Terms of Use. It applies irrespective of whether you have separately confirmed that you have read it.

Warnings, exercise descriptions and other texts displayed within the app are general information addressed to all users. They supplement this document and do not replace it; they are not individual recommendations and do not constitute medical advice.

In the event of a conflict between this document and the Terms of Use on a question of liability, section 14 of the Terms of Use prevails.

2. Trexana is not a medical device

Trexana is a fitness app. It is not intended for any medical purpose: not for the diagnosis, treatment, prevention, monitoring or alleviation of any disease, injury or health condition, and not for rehabilitation after any of them. It is not a medical device and is not registered as one in any jurisdiction.

The information the app provides — technique ratings, lists of errors, recommendations, exercise descriptions and warnings — is general information intended to support your own decisions. It does not constitute medical advice, a medical opinion or an assessment of your fitness to exercise.

3. Functionality and its limits

The app assesses the technique of physical exercises by means of computer vision: it determines body position, joint angles and symmetry of movement, and on completion of a set produces a rating, a list of typical errors and recommendations for correcting them. The app additionally keeps a training history, reflects changes in your metrics over time and offers exercise programmes.

The exercise programmes offered by the app are pre-composed sets grouped by difficulty level. They are not composed for you individually and take no account of your medical history or of any other information about your state of health.

The app does not perform diagnosis and does not detect injuries, diseases or other health conditions. It does not monitor your physiological state during training, including heart rate, blood pressure, breathing or fatigue. It does not replace examination by a doctor, physiotherapist or qualified trainer. It takes no account of your medical history, medication taken or individual restrictions on physical activity, and it does not determine whether a particular exercise or load is safe for you.

4. Conditions of use: age, state of health and assumption of risk

Age. The app may be used only by persons aged 18 and over. The restriction is deliberate: the technique assessment is produced automatically, without the involvement of a trainer or doctor, and for minors this would require a level of parental control and medical supervision that we do not provide.

State of health. A state of health that permits physical exercise without medical supervision is a condition of using the app. Before you begin training you must assess whether this condition is met — on your own or, in the circumstances set out in section 5, on the basis of medical advice. The condition applies throughout your use of the app: if your state of health changes, the assessment must be repeated before you continue. Use of the app in breach of this section is use contrary to the Terms of Use.

Assumption of risk. Physical training involves exertion and carries a risk of injury that is inherent in physical activity as such and exists irrespective of the app. By training with the app you assume that inherent risk. This assumption of risk relates to your own decision to perform, modify or stop an exercise. It does not extend to loss or injury for which we are liable under section 14 of the Terms of Use, and it does not limit that liability.

5. Circumstances requiring prior medical advice

Where any of the following circumstances applies to you, medical advice on whether and how you may exercise must be obtained before you begin training with the app:

Pregnancy and the postpartum period. The app was not designed as a training programme for pregnancy or the postpartum period. It does not determine which exercises, if any, are suitable during these states and does not adapt exercises or programmes to them. Whether, in what form and to what extent you may exercise during pregnancy and after childbirth is for your doctor to determine — before you begin training and again whenever your condition changes.

If doubt as to your state of health arises before you begin using the app or during a workout, medical advice must be obtained before you start or continue.

The requirements of this section apply irrespective of whether the app displays a warning.

6. The health questionnaire

The app allows you to record in your profile, on a voluntary basis, whether certain of the circumstances listed in section 5 apply to you. The questionnaire may be skipped or left empty, any entry may be removed and the display of warnings may be switched off at any time; the app functions in full without it. Your entries are stored on your device only and are not transmitted to our servers — see the Privacy Policy.

The entries may be used to display a warning before certain exercises. Such warnings are reminders only: they are not exhaustive, are not tailored to you, do not prevent you from performing an exercise and do not replace the medical advice required under section 5. The absence of a warning does not mean that an exercise suits you or that no risk is present. The app does not verify your entries, draws no conclusions about your state of health from them and does not determine whether an exercise is safe for you.

7. The app is not a rehabilitation tool

The app is not intended for recovery after injury, illness or surgery and does not replace physiotherapy, therapeutic exercise or the instructions of a treating doctor. While treatment is ongoing or has recently been completed, physical activity may be undertaken only to the extent determined by the professional treating you.

8. Priority of medical advice and of your own perception

The app’s ratings, cues and recommendations relate to the technique of a movement and never override medical advice. Where the app’s guidance conflicts with advice given to you by a doctor or other health professional, that advice prevails.

Where performing a movement in the manner the app suggests causes pain or any of the signs listed in section 9, you must stop, irrespective of the rating or cue displayed. A “good technique” rating is not an instruction to continue.

9. Grounds for stopping an exercise

An exercise must be stopped immediately if any of the following occurs:

Training must not be resumed until the cause of the symptoms has been established. Where symptoms are pronounced, persist or recur, medical advice must be obtained before you train again.

Chest pain, severe shortness of breath, loss of consciousness or any other sign of an acute condition is a medical emergency — see section 13.

10. Requirements for the training area and equipment

Before beginning a workout you must ensure that there is sufficient clear space around you free of obstacles; that the floor surface is not slippery; that your footwear and clothing are suitable for the exercise and do not restrict movement; that the device with the camera is stably positioned and cannot fall; and that no other person or animal is within the training area during the exercise.

Where equipment or training machines are used, you are responsible for their good working condition, correct assembly and correct loading. The app has no information about the state of equipment or the load used and does not assess them.

11. Limits of the analysis and basis of recommendations

The analysis is based on detecting key body points in the camera’s video stream and is an estimate. Its accuracy depends on lighting, camera angle and distance, clothing, background, individual body build and the limitations of the algorithm. The app may fail to detect an error or indicate an error where none is present. The app does not perceive the load or weight used or your fatigue, and it does not detect an emergency.

A “good technique” rating does not guarantee the absence of injury risk and does not mean that the exercise is suited to your state of health.

Recommendations on technique and exercise selection are based on generally accepted training practice and on knowledge that is continually evolving. We do not warrant that they reflect the most recent research findings. No training result is guaranteed — see the section on quality of the service in the Terms of Use.

12. Liability

Our liability in connection with the app, including liability for injury to life, body or health, is governed exclusively by section 14 of the Terms of Use, including the carve-outs provided for there. Nothing in this document — in particular sections 4 and 8 — limits that liability or restricts those carve-outs.

13. Medical emergencies

The app is not intended for responding to medical emergencies and must not be used for that purpose. Where life or health is at risk, contact your country’s emergency services.

14. Changes and language versions

This document is amended in the manner provided for the Terms of Use in section 19 of the Terms of Use.

This document is published in English, Russian, German, Spanish, French and Portuguese. All versions are updated simultaneously and are identical in content. In the event of a discrepancy between versions, the English version prevails, except where mandatory rules of the law of your country of residence require otherwise.
